Definitions
Duty Motel refers to the www.dutymotel.co.nz website and is one of the trading names of Jasons Travel Media Ltd.
Holiday Guide refers to the www.holidayguide.co.nz website and is one of the trading names of Jasons Travel Media Ltd.
Room Search refers to the www.roomsearch.co.nz website and is one of the trading names of Jasons Travel Media Ltd.
Agent refers to authorised iSite and Travel Agent users of the Room Search website.
Note: users may access the above websites through other domain names / URLs.
 
Membership
1. Membership of the Duty Motel system is restricted to current MANZ members and members of local motel associations that are affiliated to MANZ. A MANZ membership number may be required to join the Duty Motel system.
2. The motel is the member, not the owner / manager of the motel. Changes of ownership will not affect your membership, however you MUST advise of any any ownership changes and ensure that all invoices are paid in full BEFORE any changes.
3. If a Duty Motel member no longer meets the membership requirements then their Duty Motel membership will be revoked.
 
Accommodation Provider's Responsibilities
4. The Accommodation Provider is responsible for payment for all service fees.
5. Accommodation Providers must accurately portray (and keep updated) their availability and details about their property and service in the Duty Motel system. All prices must be in NZ dollars and include GST. The accommodation provider must ensure that prices they set within the system are within their published general price range and that the polices applying to bookings are accurate. Any deliberate attempt by an Accommodation Provider to gain any benefit through misuse of the Duty Motel system may result in termination of their membership.
6. Accommodation Providers must inform us of any changes of ownership. In addition accommodation providers must inform the new owners of their obligations to the online Duty Motel.
 
Branch/Group Co-Ordinator's Responsibilities
7. The designated branch/group co-ordinator is the main contact point between us and the local branch. The co-ordinator can view a list of active users/motels for their branch/group and can also see when motels have updated - this allows the branch to ensure the success of the Duty Motel scheme in their region.
 
Invoices
8. Invoices will be emailed to individual motels at the start of the Duty Motel membership year (1st Feb). Invoices will not be sent via standard mail.
9. Invoices must be paid in full within 14 days of the invoice date. Invoices are to be paid in one single payment. Any payments made by direct bank credit must include the invoice reference in the description.
10. Failure to pay an invoice in full within the allowed 14 day payment period will result in a late payment penalty of 5% of the outstanding invoice amount. This charge will be applied on a monthly basis until payment for the invoice is received.
11. Failure to pay an invoice in full within 30 days of invoice date may result in termination of membership for the motel. A deposit may be required if the motel wishes to rejoin the Duty Motel system. If an invoice is outstanding for more than 30 Days then a debt collection agency may be used which may incur additional charges.
12. All membership fees are non refundable.
 
Online Availability & Booking via Holiday Guide and other commission-free sales channels
13. All terms and conditions governing commission-free online availability and booking are listed in the Holiday Guide Terms Of Use. By making rooms available for commission-free online booking via Duty Motel, the user accepts these terms and conditions.
 
Usage Of Room Search and other commissionable sales channels
14. By making rooms available to the Room Search service the accommodation provder agrees to the terms and conditions on the Holiday Guide Terms of Use. No commission or fee is payable by Agents to Jasons for bookings / reservations made via Room Search.
15. In the absence of any written commercial agreement between the Accommodation Provider and the Agent the following rules will apply to bookings made via commissionable channels:
a) The Agent will earn 10% commission on the total charge for accommodation advised at time of booking. The Agent is not entitled to earn commission on any other charges not advised at time of booking.
b) Neither the Accommodation Provider or Agent may make any deduction to either the total accommodation charge or the commission.
c) The Agent must make payment in full to the Accommodation Provider for all agreed charges (less commission) within 21 days of the booking date.
d) The Accommodation Provider may make reasonable late payment charges to the according to their terms and conditions advised at time of booking if payment is not received within 21 days of booking.
e) The Accommodation Provider can only make charges for cancellation and changes to bookings that are detailed in the Accommodation Provider's policies at the time of booking.
f) No commission is payable by the Accommodation Provider if a reservation is cancelled.
16. The Agent must inform the Accommodation Provider as soon as practical with changes to or cancelled reservations.
If the Accommodation provider is unable to provide the services agreed to with the Agent then the Accommodation Provider must advise the Agent as soon as practical, and where necessary help the Agent find alternative accommodation of a similar price/quality in the local area.
In the case of any bookings genuinely made in error, the Agent may cancel the booking without charge within 30 minutes of making the booking providing that the guests are not due to arrive at the property for at least 6 hours. Confirmed reservations cannot be cancelled using this process if the customer has simply changed their mind or if multiple bookings have been made with the intention of cancelling one or more.
17. Jasons accepts no liability if the agent or accommodation provider cannot pay the other party in full or the Accommodation Provider is able to offer the services agreed to.
18. All commissionable bookings are legal contracts between the accommodation provider and the agent and are governed by the terms and conditions on the Holiday Guide Terms of Use.
 
General
19. Duty Motel members that use our commission-free or commissionable online booking services must guarantee their room availability set to these sales channels as bookings are confirmed at time of booking and can only be cancelled in exceptional circumstances.
20. Duty Motel will endeavor to provide as reliable a service as possible, however Duty Motel cannot guarantee availability of the system at any given time. Subsequently, Duty Motel is not liable for any direct or indirect losses incurred by members by non-availability of the system. If non-availability of the system exceeds 24hours then a pro-rata credit of any system usage fees will be added to members accounts.
21. All bugs, issues and errors must be reported to Duty Motel as soon as practical. Duty Motel is not liable for any direct or indirect losses incurred by members as a result of any bug, error, ommission in the system or any corruption of data held within the system.
22. We reserve the right to change the terms and conditions and pricing of services at any time.
23. We reserve the right to refuse membership, to revoke membership or to restrict services to any user or group of users. Duty Motel may elect not to provide a reason; in all cases the decision will be final and no correspondence will be entered into.
24. All parts of the Duty Motel website are copyright of Jasons Travel Media Ltd (and other companies/organisations) and may not be used for any purpose without prior permission.
25. Information entered into the Duty Motel system may be used on other websites/services specified by us.
26. All users of the Duty Motel website agree to all parts of the terms and conditions listed above.
